NSE Data has in its possession, from time to time, a high speed real time composite signal of data containing Stock Exchange trade quotations and other related information regarding the trading on the Capital Market Segment, Wholesale Debt Market Segment, Futures and Options Segment, etc. (“Market Data”). NSE Data owns and operates the FixedIn Platform (“Platform”). The Platform is an integrated web-based fixed income analytics platform and the Platform offers fixed income security and portfolio analytics (“Analytics Reports”) NSE Indices Limited is also wholly owned subsidiary of NSE. NSE Indices compiles, calculates, maintains and owns rights in and to the Fixed income valuation, Fixed Income data and fixed income & hybrid Index/Indices (“Indices”). The Terms Market Data and Indices shall collectively be referred as (“Data”). Neither NSE DATA, NSE Indices and/or their group companies nor their affiliates, directors, managers, officers, employees or agents (collectively referred to as “We” hereinafter), guarantee the sequence, accuracy or completeness of the Data, Analytics Reports and/or the Platform. We make no warranties about the reliability, completeness, or timeliness of the content, Data, Analytics Reports and/or the Platform, software, text, graphics, and links. We shall not be liable in any way to any entity/entities/individuals for any delays, inaccuracies, errors in or omissions from the Data, Analytics Reports and/or the Platform, or in the transmission thereof, or any non-performance or interruption of the Data, Analytics Reports and/or the Platform or for any damages, consequential or otherwise, arising there from or occasioned thereby. We do not make any warranties, express or implied, with respect to the Data, Analytics Reports, Platform and/or any information, data, software, system, functionality, statements or products made available on the Platform. The Data, Analytics Reports and the Platform and all content, materials, information, software and services provided on the Platform, are provided on an "as is" and "as available" basis. We do not warrant that the Platform will operate error-free or that the Platform and its servers are free of computer viruses or other harmful mechanisms. We disclaim all warranties, whether express or implied, to the fullest extent permitted by law, including the merchantability or fitness for particular purpose and non-infringement of any third party intellectual property. We expressly disclaim any and all liability for any damages or losses arising out of or related to the Data, Analytics Reports and/or the Platform including any and all direct, special, punitive, indirect, or consequential damages (including lost profits), even if notified of the possibility of such damages.
